A legally enforceable contract must hold an agreement between the parties i.e. there must be consensus on all the essential terms. This was the main principle held in the case concerning Mathieson Gee (Ayrshire) V Quigley 1952 SC (HL) 39 where M offered to supply equipment necessary for the removal of silt but Q thought the offer was to remove the silt from his pond and accepted.
