Discrimination is defined in the Race Relations Act 1976: "A person discriminates against another in any circumstances relevant for the purposes of any provision of this Act if- (a) on racial grounds he treats that other less favourably than he treats or would treat other Persons" As per the definition of just, the CJS should strive to act in a way which is "morally right and fair, appropriate and deserved"4. There is clearly a discrepancy between discrimination and justice; justice cannot be served in an environment where discrimination exists. Discrimination is unlawful according to various acts of parliament5 and Article 14 of the European Convention on Human Rights (which has domestic affect as of the Human Rights Act 1998).
