... the Catholic order (the respondents) known as the "Christian Brothers" were charged with physical and sexual abuse of young boys, in their care, at a Catholic training school. They applied to a superior court judge for an injunction, restraining the CBC from airing a fictional mini-series, "The Boys of St. Vincent," a program about boys who were sexually assaulted at a Catholic institution. The superior court judge restricted the CBC from broadcasting the fictional mini-series anywhere in Canada until the trials were over, and also restricted the media from reporting on the publication ban itself. At the time of the publication ban hearing, Dagenais' and Monnette's trials were in the first stages, and the other respondents were waiting to be appointed a trial judge.
