It should be noted from the outset that although a decision may violate the treaty it does not mean that the statute will be struck out, but it does mean that the United Kingdom government ensures that the law is consistent with the Convention. Since the ratification to the European Convention of Human Rights (ECHR) there was increased pressure for incorporation into English law which would mean that the provisions set forth in the Convention would be directly enforceable in the domestic courts. The Labour Party in their manifesto undertook to incorporate the Convention rights.
