Despite this, however, there is an underlying similarity between the constitutions in terms of basis. While the US have a formal written constitution; its provisions were not new as such. Indeed, while many aspects of the British constitution are covered by common law, the US constitution contains similar provisions, just formally set out, such as the right to free speech established in the 1st Amendment to the US constitution. Indeed, it would be true to say that many of the principals not relating to the apparatus of government established in the US constitution are merely common law precedents legally recognised.
