She then went on to pour the rest of the ginger beer into her glass, at which point the remains of a decomposing snail also came out of the bottle. As a result of drinking a ginger beer, Mrs Donoghue became ill and suffered from gastroenteritis and shock. She then went on to sue the manufacturer of the ginger beer. At the time in law, the only remedy available would have been through an action in contract law, but this was unavailable to Mrs Donoghue as a friend bought the drink for her, and therefore the contract existed between her friend and the cafe owner to which she was not privy.
